OffConOn Collect
You agree to provide true, accurate and complete information as prompted by the Registration form for your Member Account, and to update this information to maintain its truthfulness, accuracy and completeness. OffConOn may suspend or terminate your Member Account if information you provide is not complete or accurate.
To join the OffConOn network you will have to complete our online registration form, where we ask you to provide us with information about you as you must fill up.
Because you control your user profile, these details are available to you at any time by accessing your “Members Area” pages, which gives you the chance to correct or update your information at any time by just logging in to OffConOn.
Once you have created a Profile, we will automatically track certain information such as your IP and email addresses. For safety and security and to ensure you have the best possible user experience, we require users to verify their accounts (because we want to make sure you are not a robot!)
When using the site you should assume that anything you post or submit will be publicly viewable and accessible, both by Members of the site and non-Members of the site.
Please remember that photographs or any video clips that you post on OffConOn may reveal these kinds of sensitive personal data. Where you do upload and choose to tell us sensitive information about yourself, you are explicitly consenting to our processing your information and making this public to other users. When you post information about yourself or use the messaging, the amount of personal information you share is at your own risk. If you post anything that is inconsistent with our Terms, we reserve the right to terminate your account.
We collect financial information necessary to process your payments as per your chosen payment method. Please note that we do not store any credit card or other payment card details. However, our payment service providers do (and are approved to do so by all applicable regulatory bodies).
When you access OffConOn we collect certain technical information about your computer system or mobile device and statistical data. We use this information to improve our site.
If you have registered on one of our partner websites, your Profile will be available to all users of the OffConOn social network whether via our site or our partners' websites. Remember that when you register with a OffConOn partner, you are also giving them personal information, so we recommend that you read their privacy policies as OffConOn does not control how they use their information. If you have registered on one of our partner websites, or you have verified your account via a partner website, we may connect your OffConOn profile with your profile on such partner website. We may do this by way of new products and applications which we introduce from time to time, including new products powered by our group companies. If you have created a OffConOn profile through a partner website and you do not want to link your OffConOn profile to your profile on the partner website, OffConOn cannot amend these settings. Please visit the application settings on your partner website profile and follow the instructions to remove the OffConOn access permissions.
We collect certain personal information about visitors and users of our Sites. The most common types of information we collect include things like: user-names, member names, email addresses, IP addresses, other contact details, survey responses, blogs, photos, payment information such as payment agent details, transactional details, tax information, support queries, forum comments, content you direct us to make available on our Sites (such as item descriptions) and web analytics data. We will also collect personal information from job applications (such as, your CV, the application form itself, cover letter and interview notes).
In order to use the Services, you need to provide us with a valid email address, and for Services that require registration, a name associated with your account that you can choose and that represents your identity on OffConOn. You may review, change, or remove that name through your account settings. You need to provide this information to enable us to provide you with the Services.
Depending on which services you choose to use, additional information, such as a shop name, billing and payment information (including billing contact name, address, telephone number), a telephone number, and/or a physical postal address, may be necessary in order for us to provide a particular service. You are not required to provide us with this information to sign up, but we will need it to provide certain services. For example, we need a physical postal address if you are buying something on the Site for delivery.
We may contact individual shop owners confidentially to request more information about their shops or items listed through the Services, or to ensure compliance with our rules and applicable law. In order to use certain products or services on OffConOn, you may be required to complete an application; information that you submit through the application processes will not be displayed publicly and will only be used internally by OffConOn, unless otherwise specified.
You may provide your name and other personal information in connection with your account and activity. You can edit or remove this information through your account settings.
The name associated with your account, which you may review and change in your account settings, is publicly displayed and connected to your OffConOn activity. Other people may see the date you joined; ratings, reviews and related photos for items you purchased or sold; your activities; your profile information; items you listed for sale; your shop pages and policies; your Favorites, wishlists, followers,and those you follow; sold item listings and the number of items sold; comments you post; and information you decide to share via social networks.
Members information usage
We may use material that you post on the open access areas of OffConOn in advertising and promotional materials on our partner sites and partner products. We believe these uses allow us to improve our site and better tailor your online experience to meet your needs.
We use your personal information to resolve disputes, troubleshoot problems and enforce our Terms and Conditions of Use.
On your “Members Area” page on OffConOn offers you the opportunity to receive emails from us about new message notifications or other purposes related to the use of the website.
OffConOn 'cookies' collect and usage
We collect personal information directly when you provide it to us, automatically as you navigate through the Sites, or through other people when you use services associated with the Sites.
We collect your personal information when you provide it to us when you complete membership registration and buy or provide items or services on our Sites, subscribe to a newsletter, email list, submit feedback, enter a contest, fill out a survey, or send us a communication.
We collect information by placing cookies on your computer or mobile. A cookie is a piece of text stored on your computer or mobile by your web browser. They are basically a tool that stores information about website visits, recognises you and your preferences each time you visit OffConOn, and ensures site functionality and enables us to provide the services our members request.
When you visit the publicly available sections of OffConOn, a session ID cookie is placed on your computer that only lasts while you're visiting. We also place persistent cookies (also known an local storage devices) on members' computers, so that OffConOn remembers them and makes their login experience faster and easier. We may use persistent tracking cookies on your mobile device, mainly for security protection purposes, such as to prevent phishers, scammers, unauthorised log in attempts, and to help you access your hacked account. We do not use any information whilst you are logged off.
You may set your browser and your mobile settings to block cookies and local storage devices, but if you do so, you may not be able to access the features that OffConOn offers.
OffConOn uses cookies and local storage devices for a number of reasons, including to ensure the security of our site, to provide you with features you have requested and to analyze how members and visitors use OffConOn. OffConOn`s use of cookies and local storage devices basically falls into categories:

- We may use persistent cookies, which will help us to ensure we have identified the same device is logging into the correct account. These types of cookies also help with our anti-spam measures and may help us to prevent phishers, scammers, unauthorised log -in attempts to your account and accessing any hacked accounts.
- Site features and services cookies and local storage devices provide the functionality that our OffConOn members enjoy, such as uploading of photographs, videos, messaging, your account settings and your request to have OffConOn as your homepage or your search preference. We also use cookies to help provide experiences, such as links to other social media sites, social plugins and video content, including making it easier for you to share content between OffConOn with your other favourite social networks.
- In some cases, the site feature you choose may allow a third party to place cookies or local storage devices on your computer. The third party who places cookies on your device is responsible for how they process their data and OffConOn recommends that you read their privacy policies. Third parties who place cookies on your device when you use OffConOn include.
- We need to use certain cookies and local storage devices to ensure our members have the best possible experience, such assisting with your navigation of our site, ensuring pages load up quickly and respond faster to your requests for OffConOn services.
Beware that you may not use other users' information for commercial purposes, to spam, to harass, or to make unlawful threats. OffConOn reserves the right to terminate the accounts of those who misuse other users' information or who otherwise violate the Terms and Conditions of Use.
When you visit our Sites, there's certain information that's recorded which is generally anonymous information and does not reveal your identity. If you're logged into your account some of this information could be associated with your account. We're talking about the following kinds of details:

- the name of your internet service provider is sometimes captured depending on the configuration of your ISP connection;

We may use and store information about your location to provide features and to improve and customize the Services, for example, for OffConOn's internal analytics and performance monitoring; localization, regional requirements, and policies for the Services; for local content, search results, and recommendations; for mapping services; and (using non-precise location information) marketing. If you have consented to share your precise device location details but would no longer like to continue sharing that information with us, you may revoke your consent to the sharing of that information through the settings on the Apps or on your mobile device. Some of these messages are required, service-related messages for members (such as transactional messages or legal notices). Other messages are not required, such as newsletters. You can control which optional messages you choose to receive by changing your account settings.
On occasion, We may need to contact you. Primarily, these messages are delivered by email or by push notifications, and every account is required to keep a valid email address on file to receive messages. OffConOn may also contact you by telephone to provide member support or for transaction-related purposes if you request that we call you. Additionally, and with your consent, we may send you an SMS (or similar) message or physical mail in order to provide you with customer support or to provide you with information about products and features that you may find of interest. You may update your contact preferences in your account settings.
Some messages from OffConOn are service-related and necessary for members. You agree that we can send you non-marketing emails or messages, such as those related to transactions, your account, security, or product changes. Examples of service-related messages include an email address confirmation/welcome email when you register your account, notification of an order, sales, service availability, modification of key features or functions, relaying conversations with buyers, and correspondence with OffConOn's support team.
When you register for an account, subscribe to a newsletter, or provide us with your email address or phone number, you receive notice of and agree (in some jurisdictions and situations, by an additional unambiguous consent) to receive marketing emails and messages from us. You can unsubscribe at any time from marketing emails through the opt-out link included in marketing emails or messages. Members may also control some marketing emails or messages through their account settings as well as through the opt-out link included in marketing emails or messages.
Third parties
We do not sell or rent out any personal information about you to any third party. OffConOn discloses aggregated non-personal data for marketing and promotional purposes. That means we do not disclose any information that could be used to identify you.
We may share aggregated information with such parties that includes your personal information (but which doesn't identify you directly), together with other information including log data with third parties for industry analysis and demographic profiling and to deliver targeted advertising about other products and services.
In particular, in relation to targeted advertising, we use third-party advertising companies to serve ads when you visit our Website. These companies may use information about your visits to this and other websites in order to provide advertisements about goods and services of interest to you.
If you choose to, we may share your information with vendors, service providers, and other carefully selected third parties to improve our services to you, such as by facilitating payments. We ensure these parties must adhere to strict data protection and confidentiality provisions that are consistent with this Privacy Policy.
OffConOn also wishes to maintain a healthy community, and we will cooperate with all law enforcement inquiries and with all third parties to enforce their intellectual property or other rights. We may also disclose your personal information to government or law enforcement agencies, or private parties, as required by law when/or, in our sole discretion, we believe that disclosure is necessary to protect our legal rights, or those of third parties and/or to comply with a judicial proceeding, court order, or legal process served on us.
In the event that OffConOn or any of its affiliates undergoes a business transition or change of ownership, such as a merger, acquisition by another company, re-organisation, or sale of all or a portion of its assets, or in the event of insolvency or administration, we may be required to disclose your personal information.
How we use personal information
- To fulfil a contract, or take steps linked to a contract: in particular, in facilitating and processing transactions that take place on the Site, like where you purchase an item from our marketplaces.
- Where this is necessary for purposes which are in our, or third parties, legitimate interests. These interests include:

Data storage
OffConOn is a global website operating through servers located in a number of countries around the world. If you live in a country with data protection laws, the storage of your personal data may not provide you with the same protections as you enjoy in your country of residence. By submitting your personal information, or by choosing to upgrade the services you use, or by making use of the applications available on OffConOn, you agree to the transfer of your personal information to, and storage and processing of your personal information in, any such countries and destinations.
We are based in United Kingdom so your data will be processed in United Kingdom. Some of the recipients we have described earlier they are based outside in based locations. We do this on the basis of your consent to this policy in order to protect your information, we take care where possible to work with subcontractors and service providers who we believe maintain an acceptable standard of data security compliance.
We retain your personal information for as long as is necessary to provide the services to you and others, and to comply with our legal obligations. If you no longer want us to use your personal information or to provide you with the OffConOn services, you can request that we erase your personal information and close your OffConOn account. Please note that if you request the erasure of your personal information we will retain information from deleted accounts as necessary for our legitimate business interests, to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the terms of service and take other actions permitted by law. The information we retain will be handled in accordance with this Privacy Policy.
If you're a user or visitor in the European Economic Area these rights also apply to you. For the purposes of applicable EU data protection law (including the General Data Protection Regulation 2016/679 (the “GDPR”), we are a 'data controller' of your personal information.
You are also entitled to ask us to port your personal information (i.e. to transfer in a structured, commonly used and machine-readable format, to you), to erase it, or restrict its processing. You also have rights to object to some processing that is based on our legitimate interests, such as profiling that we perform for the purposes of direct marketing, and, where we have asked for your consent to process your data, to withdraw this consent as more fully described below.
These rights are limited in some situations for example, we can demonstrate that we have a legal requirement to process your personal information. In some instances, this means that we may retain some data even if you withdraw your consent.

Security
OffConOn has implemented reasonable and appropriate security measures to protect and prevent the loss, misuse, and alteration of the information under our control, including your personal information. OffConOn uses reasonable security measures to safeguard the confidentiality of your personal information such as secured servers using firewalls. Our technical experts at OffConOn work hard to ensure your secure use of our site. While we take reasonable precautions against possible security breaches of our website, member database and records no website or Internet transmission is completely secure and we cannot guarantee that unauthorised access, hacking, data loss, or other breaches will never occur. We urge you to take steps to keep your personal information safe (including your password) and to log out of your account after use. We cannot guarantee the security of your personal data while it is being transmitted to our site and any transmission is at your own risk. Once we have received your information we have procedures and security features in place to try to prevent unauthorised access.
You may not disclose your password to any third parties or share it with any third parties. If you lose your password or give it out, your personal information may be compromised. If that happens you must change your password immediately. OffConOn cannot be held responsible for your failure to keep your password secure and failure to do so may violate our Terms and Conditions of Use.
We store personal information on secure servers that are managed by us and our service providers, and occasionally hard copy files that are kept in a secure location in United Kingdom. Personal information that we store or transmit is protected by security and access controls, including username and password authentication, two-factor authentication, and data encryption where appropriate.
We will disclose personal information to the following recipients:
- companies that are in the OffConOn group which are located in United Kingdom.
- authors of any items or services made available to you, so they can facilitate support and license validation, who maybe located in any of the countries our products are available in;
- subcontractors and service providers who assist us in connection with the ways we use personal information (as set out above), in particular: website hosting providers which are located in United States and United Kingdom; technical and customer support services which are located in United Kingdom; recruitment agencies which are located in United Kingdom; marketing and analytics services which are located in the United Kingdom; security and fraud prevention services which are located in the United Kingdom and United States; subscription management services which are located in the United States; payment processing services which are located in the United States and United Kingdom; identification verification services located in the United Kingdom; and operational tooling services which are located in the United States and United Kingdom. Noting that our subcontractors and services providers may also transfer and access such information from other countries in which they have operations.
- our professional advisers (lawyers, accountants, financial advisers etc.) which are located in United States and United Kingdom;
- regulators and government authorities in connection with our compliance procedures and obligations;
- a purchaser or prospective purchaser of all or part of our assets or our business, and their professional advisers, in connection with the purchase;
- a third party to respond to requests relating to a criminal investigation or alleged or suspected illegal activity;
- a third party, in order to enforce or defend our rights, or to address financial or reputational risks;
- a rights holder in relation to an allegation of intellectual property infringement or any other infringement; and
- other recipients where we are authorised or required by law to do so.
Your Rights
You can review and revise your profile information at any time. Once you register, you will be able to review and change much of your personal information. Please promptly update your information if it changes by signing-in to your account and following the screen prompts. We strongly urge you to periodically change your password to help reduce the risk of unauthorised access to your account information.
If you want delete your profile, sign in with your password and delete your profile. To prevent abuse and/or misuse of OffConOn by a user following termination or deletion of a profile/account we shall retain such information as we deem in our sole discretion may be necessary to ensure that user does not open a new account and profile in breach of our Terms and to ensure compliance with all laws and regulations. Even after you remove information from your profile or delete your account, copies of that information may still be viewable and/or accessed on the Internet to the extent such information has been previously shared with others, or copied or stored by other users or to the extent such information has been shared with search engines. We cannot control this, nor do we accept any liability for this. If you have given third party applications or websites access to your personal information they may retain such information to the extent permitted under their terms of service or privacy policies.
If you have not signed in to OffConOn for three months, we may remove your Profile as part of our data cleansing process.
Your OffConOn account is non-transferable and any rights to your profile or contents within your account will be cancelled upon your death.
You can access some of the personal information that we collect about you by logging in to your account. You also have the right to make a request to access other personal information we hold about you and to request corrections of any errors in that data. You can also close the account you have with us for any of our Sites at any time. To make an access or correction request, contact us.
Where we have your consent to do so (e.g. if you have subscribed to one of our e-mail lists or have indicated that you are interested in receiving offers or information from us), we send you marketing communications by email about products and services that we feel may be of interest to you. You can ‘opt-out' of such communications if you would prefer not to receive them in the future by using the “unsubscribe” facility provided in the communication itself.
You also have choices about cookies. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject cookies some parts of our Sites may not work properly in your case.
Community & Chat
We offer several features that allow members to connect and communicate in public or semi-public spaces. You don't have to use these features, but if you do, please use common sense and good judgment when posting in these community spaces or sharing your personal information with others through the Services. Be aware that any personal information that you choose to submit there can be read, collected, or used by others, or could be used to send unsolicited messages to you. We may engage certain third parties to assist in providing community services to you and, in the context of that relationship, we need to share some of your information with such third parties in order to provide that service. We generally does not remove content from community spaces, and your posts may remain public after your account is closed, although your name will no longer be displayed alongside the post. Buying and Selling
As part of the buying and selling process, OffConOn will facilitate the sharing of information between the two members involved in the transaction, such as the other OffConOn member`s shipping address and payment information. By making a sale or a purchase on OffConOn, you are directing us to share your information in this way. Since this is an important part of the Services we provide, we need to do this in order to perform our obligations under our Terms of Use. We expect you to respect the privacy of the member whose information you have received. OffConOn has not granted a license to you to use the information for unsolicited commercial messages or unauthorized transactions. Without express consent from that person, you must not add any member to your email or physical mailing list or otherwise use or store any member's personal information.
Your Responsibilities
If you sell using our Services you may receive and determine what to do with certain personal information, such as when communicating with users and entering into transactions with buyers. This means you process personal information (for example, buyer name, email address, and shipping address) and, to the extent you do so, under EU law, you are an independent controller of data relating to other users that you may have obtained through the Services.
You are responsible for protecting user personal information you receive or process and complying with all relevant legal requirements when you use the Services. This includes applicable data protection and privacy laws that govern the ways in which you can use a user's information. Such laws may require that you post, and comply with, your own privacy policy, which must be accessible to OffConOn users you interact with and compatible with this policy and OffConOn's Terms of Use. As a data controller, to the extent that you process user personal information outside of the Services, you may be required under applicable data protection and privacy laws to honor requests for data access, portability, correction, deletion, and objections to processing. Also, if you disclose personal information without the buyer's proper consent, you are responsible for that unauthorized disclosure. This includes, for example, disclosures you make or unintentional data breaches. For example, you may receive a buyer's email address or other information as a result of entering into a transaction with that buyer. This information may only be used for OffConOn-related communications or for OffConOn-facilitated transactions. You may not use this information for unsolicited commercial messages or unauthorized transactions. Without the buyer's consent, and subject to other applicable OffConOn policies and laws, you may not add any OffConOn member to your email or physical mailing list, use that buyer's identity for marketing, or obtain or retain any payment information. Please bear in mind that you're responsible for knowing the standard of consent required in any given instance.
If OffConOn and you are found to be joint data controllers of personal information, and if OffConOn is sued, fined, or otherwise incurs expenses because of something that you did as a joint data controller of buyer personal information, you agree to indemnify OffConOn for the expenses it occurs in connection with your processing of buyer personal information.
Withdrawing Consent
